We, MORA Discount-Haustechnikstore OG, take the protection of your personal data very seriously and strictly adhere to the rules of data protection laws. We process your data exclusively on the basis of the applicable legal provisions (GDPR, DSG, TKG). The following declaration gives you an overview of how we ensure this protection, what type of data is collected for what purpose and informs you of your rights as a data subject:

3. COLLECTION AND PROCESSING OF PERSONAL DATA
PART I – GENERAL BUSINESS OPERATIONS / CUSTOMERS AND SUPPLIERS
A) CONTACT / CONTRACTUAL RELATIONSHIPS
Business relationship
When you contact us, your details will be processed for the purpose of processing the contact request and its handling in accordance with Art. 6 Paragraph 1 Letter b of GDPR. The purpose of data processing is therefore, on the one hand, to establish contact and, on the other hand, to exercise or fulfil the rights and obligations arising from the business relationship, its fulfilment and administration, and to deal with your concerns.
For example, your details from our contact form, including your personal data, will be sent to us via our own mail server to process your request, further processed and stored by us. Without this data, we cannot process your request.
For the purpose of processing these (pre-)contractual relationships, the following personal data is processed in particular:
- personal identification and contact information (e.g. title, name, address, date of birth, email address, telephone number);
- Payment data (e.g. account details);
- Data from the fulfillment of our contractual obligations (e.g. delivery addresses, property properties, invoice data);
- Advertising and sales data (e.g. information on consent given or revoked).
In addition, we process data that we lawfully receive from publicly accessible sources (e.g. commercial register, land register, association register, etc.).
Voluntarily disclosed data
If you voluntarily disclose data that is not requested, you thereby give your express consent to the processing of this data in accordance with this data protection declaration. You have the right to revoke any consent given in whole or in part at any time.
B) MARKETING
Direct marketing
If you have also provided us with your email address in connection with the sale of goods or a service, we may send you direct advertising by email in the form of information and mailings for our own or similar services based on our legitimate interest in accordance with Art. 6 (1) (f) GDPR. You have the right to object at any time to the processing of data concerning you for the purpose of such advertising. In this context, we may also carry out the following data processing - in each case based on our legitimate interest in accordance with Art. 6 (1) (f) GDPR:
- Internal procurement market analysis,
- Internal data processing and analysis to ensure that customers are addressed individually with tailor-made offers,
- Internal data processing and analysis for the purpose of improving and developing intelligent and innovative services and products,
- Asserting legal claims and defending in legal disputes,
- Presentation of our company;
- Maintain proper customer and business relations.
General Newsletter
If you have given us your email address, you will receive our regular newsletter. We only use your email address for this purpose and inform you about our services and activities, as well as news within our company and our own events. Like all consents, this can also be given by email or - if technically integrated - by unsubscribing from the newsletter using the button/link in the newsletter itself. We also use your data to send you information about new developments in our company or invitations to events. The legal basis for these purposes is your consent and our legitimate interest in a proper customer relationship within the meaning of Art. 6 Paragraph 1 Letter f of GDPR.
Newsletter tracking
Our newsletter contains so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in emails that are sent in HTML format to enable log file recording and log file analysis. This enables a statistical evaluation of the success or failure of online marketing campaigns to be carried out. The embedded tracking pixel is used to collect technical information, such as information about the browser and your system, as well as your IP address and the time of retrieval.
This information is used to technically improve the newsletter based on the technical data or the target groups and their reading behavior based on their access locations (which can be determined using the IP address) or the access times. This analysis also includes determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual recipients. However, it is neither our aim nor that of the shipping service provider, if used, to observe individual users. Rather, the evaluations serve to recognize the reading habits of users and to adapt the content to them or to send different content according to the interests of the users.
Unfortunately, a separate revocation of the performance measurement is not possible; in this case, the entire newsletter subscription must be canceled or revoked.
4. GENERAL INFORMATION ON DATA PROCESSING
Revocation of consent
You can revoke all consents given at any time and without giving a reason by sending an email to office@discount-haustechnikstore.at. Where the processing is based solely on your consent and we are not legally obliged to store it, the relevant data will then be irrevocably deleted. The revocation does not affect the legality of the processing carried out on the basis of the consent until the revocation.
Transmission of data
Any disclosure, transmission or transfer of data to natural or legal persons who are neither processors nor authorized to process data under our direct responsibility or under the responsibility of one of our processors (third parties) will only take place in accordance with the applicable legal provisions.
We do not transfer your personal data to third parties, except
- we are legally obliged to
- this is necessary within the framework of the business relationship,
- we are otherwise commissioned by you to do so or
- the transfer corresponds to the purpose of the data processing.
In particular, transmission to public bodies, e.g. tax authorities, wholesalers, judicial and law enforcement authorities (e.g. police, public prosecutors, courts), lawyers and notaries as well as auditors may be necessary. Furthermore, transmission to public bodies and institutions, such as tax authorities, social insurance providers and Statistics Austria, may be required by law.
The contract processors we use may also receive data. These include companies in the categories of postal and printing service providers, IT service providers, IT support (hardware and software), sales partners, web service providers, credit agencies, debt collection service providers and other contract processors that we use as part of contract processing.
Retention period and storage period
We do not process and store the data in personal form permanently, but only in accordance with the time periods prescribed in the applicable legal provisions, but in any case for as long as this is necessary for the purpose of fully executing the agreement (including the expiry of any limitation periods and the legally binding termination of any official or judicial proceedings).
With regard to the statutory retention periods, particular attention should be drawn to:
- 7-year tax retention obligation according to BAO
- 3-year limitation period according to ABGB
(in individual cases, if there are indications, 30 years according to § 1489 ABGB)
Subject to the existence of other legality conditions within the meaning of Art 6 GDPR, stored data will be deleted immediately and not further processed following a revocation of consent in accordance with Art 7 Para 3 GDPR or a justified objection in accordance with Art 21 GDPR.
Disclaimer
Despite all precautions and measures, it cannot be ruled out that data may be disclosed, lost, damaged or altered and that you may suffer damage. The use of our services is at your own risk and at your own risk under data protection law. We therefore assume no responsibility or liability for damages and consequential damages arising from or in connection with data disclosures, losses, damaged or altered, unauthorized and/or manipulative access to or interference with data processing and transmission, and violations of data protection regulations (DS-GVO, DSG) that were not caused unlawfully and negligently by us.
We are only liable for damages - excluding personal injuries and property damage and financial losses resulting from the breach of main contractual obligations - in the event of intent or gross negligence. Furthermore, our liability is limited to the liability insurance sum available for the specific case of damage.
The above exclusions or limitations of liability also apply to our bodies, employees, representatives and attributable assistants as well as to commissioned processors and to all persons engaged by them.
Hyperlinks
Our website contains hyperlinks to websites of other providers. When you activate these hyperlinks, you will be redirected from our website directly to the website of the other provider. You can recognize this by the change in the URL, among other things. We cannot accept any responsibility for the confidential handling of your data on these third-party websites, as we have no influence on whether these companies adhere to data protection regulations. Changes to the privacy policy
We reserve the right to change or supplement the privacy policy and its attachments at any time and without giving reasons, in order to comply with the applicable legal provisions and to meet your interests (in particular transparency of processing). If your consent is required for this, the changes will only be made with your consent.
5. YOUR RIGHTS
As a data subject, you have the following rights and legal remedies:
Right to information
You have the right to request information about whether – and if so, which – personal data is being processed about you. In order to prevent information from being passed on to unauthorized persons, it may be necessary to verify your identity in the event of a request.
Right to rectification and erasure
You can request the correction/completion of your incorrect personal data as well as the deletion of your data. We will comply with this request immediately, provided that there are no legal obligations to the contrary.
Right to restriction of processing
You have the right to restrict the processing of your personal data.
Right to data portability
You can request that collected personal data be transferred to a third party.
Right of objection
Should such reasons arise from your particular situation, you can object to the processing of your personal data at any time.
